Ninth arbitration court of appeal having discontinued the proceedings on the case of Severstal versus FGC and IDGC of the North-West. The court accepted abandonment of action on the part of Severstal. For reference: Severstal, JSC lodged an action against FGC UES, JSC and Vologdaenergo branch of IDGC of the North-West, JSC in the Moscow City Arbitration Court claiming invalidation of the contract for lease of electric power grid complex facilities to the extent of application of the contract conditions to the Parties’ relationships having developed prior to the contract conclusion, since 01.07.2008. By this action Severstal, JSC tried to challenge lawfulness of IDGC of the North-west, JSC having provided electric energy transmission services using the “last mile” facilities during the period that had preceded the above-mentioned contract conclusion.
The claims were dismissed by the court judgment dated 22.05.2012. The plaintiff lodged a petition of appeal against the said court judgment. In the course of the session of the court of appeal the plaintiff declared abandonment of action. The court of appeal, having considered the request filed and having reviewed the case facts and materials, finds the abandonment of claim duly acceptable for the court, with the case proceedings discontinued.
